SCOTUS Asks Solicitor to Weigh In on ERISA Fee Question

The Supreme Court on Monday asked the acting solicitor general to weigh in on whether a retirement plan's excessive fees could run afoul of ERISA. The court requested that the Trump administration explain its view of Hughes v. Northwestern University, a case that considers whether retirees can state a claim under ERISA if their defined contribution retirement plan allegedly charged fees "that substantially exceeded fees" for other retirement options.
