Trump Administration Asks Court for Third Extension in Pause on DOL Fiduciary Rule Challenge

The Trump administration has asked the 5th U.S. Circuit Court of Appeals for a third 60-day extension to pause the consolidated lawsuit challenging the Biden-era Department of Labor (DOL) fiduciary rule. Finalized in April 2024, the Retirement Security Rule expanded fiduciary standards to include one-time advice, such as IRA rollovers or annuity purchases, requiring it to be in investors’ best interest. Industry groups sued, and courts blocked implementation before the rule took effect. The DOL says it needs more time to determine its appeals strategy while awaiting Senate confirmations of key nominees.
