SEC Widens Focus for Marketing Rule Examinations

In a new risk alert, the U.S. Securities and Exchange Commission has outlined areas of emphasis for its examiners' reviews of investment advisors’ compliance with the revamped marketing rule. The new rule, with which advisors have had to comply since November, was designed to update regulations regarding the ways advisors advertise and market their products and services. The SEC said that its examiners will continue focusing on policies and procedures, performance-advertising requirements, books and records and whether advisors can substantiate factual statements in advertisements.
