FINRA Takes Another Stab at Expungement Proposal

The Financial Industry Regulatory Authority (FINRA) is taking another shot at a proposal to amend rules for expungement. On Nov. 10, it amended an August proposal just a day before the U.S. Securities and Exchange Commission (SEC) was due to approve or disapprove it. The amended version would bar brokers from filing expungement requests of customer disputes if an arbitration panel or court previously found them liable. It would also establish that investors whose complaints are a subject to an expungement request are entitled to attend and participate in expungement hearings.
