DOL Revisits Gig Workers in New Proposed Rule

The U.S. Department of Labor (DOL) has proposed a new rule that would make it easier for businesses to classify workers as independent contractors rather than employees. The proposal largely revives a more business-friendly standard from the first Trump administration and would reverse a Biden-era rule that tightened contractor classifications and expanded worker eligibility for minimum wage and overtime protections. Under the revised framework, five factors are considered, with greater emphasis placed on how much control workers have over their jobs and their opportunity for profit or loss based on initiative or investment.
