Climate Change Activists See Big Opening at SEC with Biden
Climate change activists see an opportunity to reshape the SEC under President-elect Joe Biden to force companies to more fully disclose how their policies affect the environment. Biden’s climate plan calls for "requiring public companies to disclose climate risks and the greenhouse gas emissions in their operations and supply chains," which the SEC could accomplish by enacting new rules. Beyond disclosure rules, the SEC under a Biden administration could target enforcement action related to disclosing climate or other risks and revisit environment-specific regulations. “I do expect that under a Democrat-dominated Commission that there will be some effort to revisit some of the E in ESG,” said Ken Joseph, a managing director at Duff & Phelps who worked as a supervisor in the SEC's Division of Enforcement’s specialized asset management unit during more than 20 years at the regulator.
